Steering Through Environmental Issues During Claims

Bryan Buller, co-owner and founder of Benchmark Environmental, gave an enlightening presentation on dealing with environmental issues that arise during the claims resolution process. Mr. Buller, who has more than 12 years of diversified experience in the environmental and building inspection industry, spoke to a good-sized crowd at the February 17, 2005 luncheon meeting of the Central Coast Claims Association.

Getting an industrial hygienist onto a suspect site early in the process is the most efficient means of resolving issues. Third party evaluations offer unbiased reports that can often put a claimant's mind at ease, as well as the adjuster and any contractors on a job.

"The insurance company should not try to control the parameters of what the industrial hygienist does,' he stated. Sample costs are cheap, with immediate turnaround, so restoration does not need to be necessarily greatly impeded by the process.

Only properly certified individuals should be involved in the removal or disturbance of "friable" asbestos. He explained that there are some 3,000 building products that use asbestos, with a production date of 1980 being the "magical date" of importance.

With regard to mold issues, he said that a good rule of thumb is to consider the potential for the issue to also encompass as asbestos and lead.

A graduate in Industrial Engineering, a Certified Property Inspector, and a Certified Environmental Inspector, Mr. Buller's firm provides third party inspection services to the insurance industry.

His personal areas of expertise include forensic building and failure analysis; CAD architectural design and blue-line design drawings; project manager for city redevelopment programs, hazardous coating projects; water migration studies; air quality investigations; airborne particulate contamination; microbial contamination; fire contamination evaluation; environmental site audits Phase I and II; soils analysis; PCB identification; combustible fuels research and environmental hazard containment and mitigation design.
